Privacy Policy

We at Pacific Plate Spirits Inc. (the “Company,” “we,” “us,” or “our”) take your privacy seriously and understand that you may wish to be informed about how we treat the personally identifiable data and information, such as the name, address, email address, telephone/fax numbers, credit/debit card information, customer behavior information, demographic information, gender information and responses to survey questions (“Data”) that you may provide to us. Accordingly, we have developed this Privacy Policy (“Policy”) to explain our use of your Data as well as our precautions to keep your Data confidential and secure.  By ordering our Products (“Products”) and using or accessing our websites, services and applications (the “Services”), you are consenting to the Data collection and use practices described in this Policy, as modified from time to time by us in our sole discretion.  We reserve the right to modify our Policy and invite you to consult this Policy from time to time in order to familiarize yourself with any changes.  We will post any new Policy on our websites, changing the date at the bottom of such Policy.
The terms of this Policy are without prejudice to any contractual terms you may enter into with us, which shall prevail over the terms of this Policy.

What does this Policy cover?

This Policy covers our treatment of Data that we gather when you are using or accessing our Services, but not the practices of companies we do not own or control, or people that we do not manage.  Our websites may contain links to third-party websites.  These linked websites are not under our control, and we are not responsible for their content or privacy policies.  We provide such links only as a convenience, and the inclusion of a link on our websites does not imply endorsement of the linked site.  If you provide any Data through any such third-party website, your transaction will occur on such third party’s website, and the Data you provide will be collected by, and controlled by the privacy policy of, that third party.  We recommend that you familiarize yourself with the privacy policies and practices of any such third parties.

How will the Company use my Data?

We gather Data only for specific and limited purposes that we inform you about when you use our Services.  For example, we may use your Data to:

  • Personalize, evaluate and improve our Services;
  • Contact you;
  • Fulfill your requests for Products or Services;
  • Bill you for Products or Services that you request;
  • Verify your credit;
  • Market Products and Services we believe might be of interest to you;
  • Process your job application;
  • Send you news releases;
  • Perform statistical analyses on customer interests, purchasing and other trends; and
  • Determine product development and marketing strategies.

In certain cases, we may also share some Data with third parties, but only as described below.

In addition, from time to time, we may offer sweepstakes, contests and other promotions (each, a “Promotion”) that require online registration.  If you want to participate in those Promotions, you may be asked to provide some Data.  Some of the Data that may be requested for this purpose will be optional, but other requested Data, such as your name and e-mail address, will be mandatory because it will be needed to contact you if you win.  Also, some Promotions may require you to select a user ID and password.  You should carefully review the rules, if any, of each Promotion in which you participate through our websites, as they may contain additional important information about our use of your Data.  To the extent that the terms and conditions of such rules concerning the treatment of your Data conflict with this Policy, the terms and conditions of such rules shall control.

Does the Company Collect Data Automatically?

Whenever you interact with our Services, we may automatically receive and record certain information on our server logs from your browser or device, which may include your IP address, device identification, “cookie” information, the type of browser and/or device you are using to access our Services and the page or feature you requested.

“Cookies” are identifiers we may transfer to your browser or device that allow us to recognize your browser or device and tell us how and when pages and features in our Services are visited and by how many people.  You may be able to change the preferences on your browser or device to prevent or limit your device’s acceptance of cookies, but this may prevent you from taking advantage of some of our features.

If you click on a link to a third-party website or service, a third party may also transmit cookies to you.  Again, this Policy does not cover the use of cookies by any third parties, and we are not responsible for their privacy policies and practices.  Please be aware that cookies placed by third parties may continue to track your activities online even after you have left our Services, and those third parties may not honor “Do Not Track” requests you have set using your browser or device.

We may use the information we collect automatically to customize content for you that we think you might like, based on your usage patterns.  We may also use it to improve the Services–for example, this information can tell us how often users use a particular feature of the Services, and we can use that knowledge to make the Services interesting to as many users as possible.

Can I ask the Company not to automatically collect any information?

Your browser may offer you a “Do Not Track” option, which allows you to signal to operators of websites and web applications and services (including behavioral advertising services) that you do not wish such operators to track certain of your online activities over time and across different websites.  Our Services do not support Do Not Track requests at this time.

Will the Company Share Any of the Data it Receives?

We do not sell, rent, share or otherwise make your Data available to third parties, except when we are required to for legal or regulatory purposes or when we transfer your Data to third parties who act on our behalf for further processing in accordance with the purposes for which your Data was originally collected.  For instance, some Data, such as your IP address and email address, may be shared with  third parties we work with to run our website, advertising and email communications.  In addition, we reserve the right to access, read, preserve, and disclose any information that we believe is necessary to comply with laws or court orders; enforce or apply our terms of use, if any, and other agreements; or protect the rights, property or safety of the Company, our employees, our users or others.

Is my Data secure?

We endeavor to protect the privacy of your Data through encryption and organizational measures that limit access to your Data where feasible.  Unfortunately, we cannot guarantee complete security.  Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of user information at any time.  Accordingly, we cannot be responsible for or liable for the security of your Data when it is in transit to us over the internet.

Furthermore, individuals who are under the age of 18 or under the legal drinking age should not provide any Data to us, and we will not knowingly collect, use or disclose any Data from such individuals.  Our websites are not designed or intended to collect Data from individuals under the age of 18 or under the legal drinking age.

What Data can I access?

Under California Civil Code Sections 1798.83-1798.84, California residents are entitled to ask us for a notice that identifies the categories of Data that we share with our affiliates and/or third parties for marketing purposes and provides contact information for such affiliates and/or third parties.  If you are a California resident and would like a copy of this notice, please submit an electronic request to: info@selvarey.com.
